Domestic Works Dispute Cases Including:
Case 1: Juggling and Subtracting Dispute in Renovation Works
Background: The owner commissioned a renovation company to refurbish the kitchen, but the contractor refused to pay compensation for the large area of tiles that were hollowed out after the completion of the renovation work.
Role of our company:
- Used ‘infrared thermography’ to inspect the area of drumming and found that 60% of the tiles had not been laid in accordance with the standard.
- Samples were taken to confirm the use of poor quality adhesives in comparison with the list of materials in the contract.
Result: The expert report became the key evidence in court and the landlord was awarded full compensation + redoing costs.
Case 2: Tenant Surrendering ‘Damaged Flat’ Dispute
Background: The landlord accused the tenant of damaging the wooden floor and walls and deducted the deposit; the tenant claimed that it was natural wear and tear.
Our Role:
- Determine whether the scratches on the walls are beyond normal wear and tear by conducting a ‘coating thickness test’.
- Compare the photos of the tenant with the current situation and calculate the wear rate of the floor (if the deep scratches are man-made).
Result: The report clarified the responsibility and the court ruled that the landlord had to refund part of the deposit.
Case 3: Water Leakage Liability Determination (Upstairs vs. Downstairs)
Background: Water seepage from the ceiling of a flat downstairs, while the owner of the flat upstairs denied that there was a plumbing problem.
Our Role:
- Conduct ‘Colour Water Test’ + ‘Moisture Test’ to confirm that the source of water leakage is the modified drainage pipe upstairs.
- Provide cost estimation for the repair programme.
Result: An agreement on compensation was reached at the mediation stage, avoiding lengthy litigation.
